You are hereby notified that after careful consideration of your application
dated January 28, 1999 and after a Public Hearing as required by Chapter 40A, M.G.L., the Appeal Board voted:

REPRESENTATIONS TO BOARD:
1. The applicants requested a special permit to allow the construction of a 16’ x 22’ two-story addition to the rear of their pre-existing, non-conforming house at 81 Leon Court.
2. The existing house on a 7,189 square foot lot is 21 feet from the street and 18 and 30 feet from the sidelines. With the new addition, the house will be 27 feet from the rear lot line. It is located in Residence A and Aquifer Protection Zone II Districts.
3. The existing house is 15 feet high. The new addition, which will have a foundation, will be 22 feet high. The addition will increase the living space from four rooms to five with three bedrooms and give the applicants access to the existing cellar.
4. The Board recommended that the Montgomerys talk to the Board of Health about a potential problem with the distance between their well and septic system and those of their neighbors.
5. The board noted that the proposed changes to the pre-existing, non-conforming structure would be no more detrimental to the neighborhood.
With regard to the Special Permit the Board took into consideration each of the following:
a) Social, economic, or community needs which are served by the proposal;
b) Traffic flow and safety;
c) Adequacy of utilities and other public services;
d) Neighborhood character and social structures;
e) Impacts of the natural environment;
f) Potential fiscal impact.

DECISION:
The Application for a Special Permit is granted, subject to the following conditions:
1. Applicant shall obtain all necessary permits from all other Boards in the Town of Hanson;
2. The project shall be constructed in conformity with the plan filed with this board. .
3. This decision must be recorded with the Plymouth Registry of Deeds within one year from the filing of this decision with the Clerk of the Town of Hanson.
ANY PERSON AGGRIEVED BY THIS DECISION MAY APPEAL TO THE SUPERIOR COURT DEPARMENT FOR PLYMOUTH COUNTY, BY BRINGING ACTION WITHIN TWENTY (20) DAYS AFTER DECISION HAS BEEN FILED IN THE OFFICE OF THE TOWN CLERK.
